Department Overview
The Office of the County Counsel provides legal advice and litigation representation to the County, including the Board of Supervisors, departments, boards, and commissions. The Office of the County Counsel is committed to providing high quality representation and advice to assist the county, its Board of Supervisors and other county officials in achieving their programmatic and strategic goals. County Attorneys represent Child Welfare Services in all phases of juvenile dependency cases, as well as the Public Guardian in conservatorship court proceedings. The County Counsel’s office also provides legal services to the Local Agency Formation Commission and the San Benito County Council of Governments. The office provides legal representation and substantive work in virtually all aspects of County government, including but not limited to claims and litigation, legal advice, and transactional work.

Recent Departmental Accomplishments
• Assisted in resolving several employee matters in a successful manner.
• Long-standing litigation matters have been successfully concluded in the County’s favor, including the Award Homes/Benchmark litigation.
• Assisted with CSA concerns, DRC settlement implementation, major land use projects, and integrated waste.
Top Departmental Concerns
• The Board of Supervisors has taken action to address the Department’s previous staffing concerns. This action has been greatly appreciated.
Long Range Planning Goals (3-5 years) For Department
• We have added two limited term positions, from 2022 to 2024. The need for those positions will continue after 2024.
