Impact Fees

Impact fees are restricted one-time payments used to construct system growth related impact improvements for Fire, Parks, and Police projects that serve multiple development projects or even the entire jurisdiction. By law, impact fees can only be used for Fire, Parks, and Police capital improvements, not operating or maintenance costs. Impact fees are subject to legal standards that satisfy three key tests: need, benefit, and proportionality.

  • First, to justify a fee for public facilities, local government must demonstrate a need for capital improvements.
  • Second, new development must derive a benefit from the payment of the fees (i.e., in the form of public facilities constructed within a reasonable timeframe).
  • Third, the fee paid should not exceed a development’s proportionate share of the capital cost.
  • Impact fees are collected at the time a new development project is submitted to the City for permitting.
